General Guidelines and Terms Edible Landscape Collaboration 2021

First and foremost, thank you for your trust and willingness to collaborate. Desiring to build a fruitful and constructive relationship, I have included a number of guidelines and terms in this document. I sincerely hope that these guidelines and terms will serve as a framework for you and me to achieve the best possible collaboration based on your request and intended goal.

Please let me know if you have any questions or feedback, so I can continuously improve my service.

Collaboration guidelines:

  • Your input is important and valuable! I’d love to hear your thoughts on the project and the collaboration during our collaboration. I strongly believe we can complement each other and achieve better results.
  • Outside of office hours, I prefer to communicate via email. This way, I can dedicate time to your question in my office hours and, if desired, provide appropriate responses. I appreciate it if you group several questions and then email them. Sometimes I might suggest meeting on-site for one or more hours of consultation. This will be determined based on the question and the distance to the site.
    If you have urgent questions, you can also call me. If I’m unavailable, please feel free to leave a voicemail. I will follow up on it. Facebook and text messages will not be followed up. I don’t use WhatsApp.
  • I would like to request that invoices be paid promptly, within 15 days of receipt. This allows me to pay my suppliers and subcontractors on time and maintains a healthy cash flow within my business. I prepare invoices with great care. If you have any questions about the invoice you received, please contact me within 8 days of receipt. The applicable rates were communicated in advance by email; if you do not receive a response, I assume you have accepted them.
  • Photos will be taken during the work. These photos will be used for proper monitoring or to identify pipes and plants. These photos may also be used for promotional purposes, such as publications, advertising, websites, and customer presentations. If you do not wish this to happen, please inform us before the work begins. Please do not publish photos without prior request.

General terms and conditions:

  • Our general terms and conditions apply to all services performed by Eetbaar Landschap. By signing the quote, accepting an invoice, confirming an order by email, etc., but this list is not exhaustive, the client is deemed to accept these general terms and conditions of sale. The electronic submission of an agreement with our quote by the client is considered an electronic signature between the client and Eetbaar Landschap, and has the same value as a written signature as proof of agreement with our quote.
  • Eetbaar Landschap advises on setting up your food forest or site. My strength lies in offering a place tailored to your desires and needs, and to the desires and needs that exist within the site itself and the natural environment.
    There is currently no regulatory framework specifically for food forests. This means it’s a matter of navigating the existing regulations. I have a document available on the current policy regarding food forests and can advise you on which path you can take within the existing regulations. The policy document can be sent upon request. I use Geopunt as a reference to assess the coloring of your plot in light of potential regulatory challenges and am happy to share.

However, the ultimate responsibility lies with you, and I therefore recommend that, if you want to remain within the regulatory framework, you obtain thorough information from the municipality and the relevant services (ANB, Region, etc.). The client is responsible for informing Eetbaar Landschap in writing of the necessary instructions regarding the distances that must be observed with regard to the boundary line with other properties when planting tall trees, other trees, and living hedges. The client must submit the required permits.
Some designs deviate from applicable regulations. If this applies to you, Eetbaar Landschap cannot be held liable for any elements present in the design that may need to be removed or modified later upon inspection or determination by the regulatory framework.

  • Eetbaar Landschap takes every care to provide suitable planting on the intended site, taking into account the existing natural conditions. To create a sound planting plan, it is necessary to know the winter groundwater level and the existing microclimate. A high groundwater level is detrimental to fruit trees. If no groundwater level information is available, it is necessary to measure it in February. Sometimes, it is requested to proceed with the design before groundwater level information is available. Please be aware that this carries a risk of planting failure, and Eetbaar Landschap cannot be held liable for this. Excluded from any warranty claim are: damage, defects, or shortcomings caused by weather conditions or force majeure such as frost, flooding, high groundwater levels, droughts, heat, fire damage, etc., or interventions carried out by the client or an unauthorized third party.
  • Food forests are currently in their pioneering phase, with extensive experimentation taking place with plants from around the world and different climate zones. Experiences with introducing species from similar climate zones are predominantly positive. Before selecting plants, a site analysis is conducted to ensure the best possible placement of the plants based on the existing natural environment. Eetbaar Landschap takes great care to ensure suitable plant selection in the best possible location. However, it is normal for some of the planting to fail due to weather conditions or other natural influences. Eetbaar Landschap cannot be held liable for these failures. However, you will receive a document with recommendations for maximum success after the planting plan is completed.
  • Eetbaar Landschap will execute every agreement in good faith and according to the rules of the art. The client agrees to provide Eetbaar Landschap with a plan before the commencement of the work, clearly indicating all necessary information such as the location of utility lines, wells, and the like. If no plan is provided, or incorrect or incomplete information is provided, Eetbaar Landschap may suspend the execution of the work. Eetbaar Landschap cannot, under any circumstances, be held liable for damage to rainwater, zinc, and septic tanks, gas, oil, electricity, telephone, TV, internet, and water lines, or to foundations, facades, walls, or buildings. This list is by no means exhaustive. If, during the execution of the work, it becomes apparent that waste or waste materials are present in the soil, the costs and taxes associated with the removal, transport, processing, or storage of these materials and substances will be borne by the client, unless otherwise agreed between the parties in the quotation.
  • Delivered materials remain the property of EETBAAR LANDSCHAP until the full amount due has been settled. In the event of non-payment, EETBAAR LANDSCHAP reserves the right to repossess the materials at the client’s expense. EETBAAR LANDSCHAP’s materials are only covered by its own civil liability. The client is responsible for the supervision and protection of the delivered and/or installed materials from the moment of delivery or installation. The client shall take all measures to keep the materials in good condition to prevent acts of vandalism or theft.
